YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR

OTHER MATTER RELATING TO THE ISLAMICWELL.COM.

IF THIS LIMITATION OF LIABILITY OR

THE EXCLUSION OF WARRANTY IS HELD

INAPPLICABLE OR UNENFORCEABLE FOR ANY

REASON, THEN ISLAMICWELL.COM’s MAXIMUM

LIABILITY FOR ANY TYPE OF DAMAGES SHALL BE

LIMITED TO THE LOWER OF U.S. $100.00 OR THE AMOUNT PAID FOR THE

SERVICE.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of islamicwell.com or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Islamicwell.com reserves the right to modify or discontinue, temporarily or permanently, any services with or without notice to you. You agree that islamicwell.com shall not be liable to you or any third-party for any modification or discontinuance of the Service.

Islamicwell.com reserves the right to change this agreement at any time by reposting an updated TOU to this website.

ISLAMICWELL.COM HAS ITS ORIGINS IN THE UNITED STATES. THEREFORE IT CANNOT MAKE REPRESENTATIONS THAT THE MATERIALS ACCESSED THROUGH THE SERVICE ARE APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. THOSE WHO CHOOSE TO ACCESS THE SERVICE FROM OTHER LOCATIONS DO SO ON THEIR OWN VOLITION AND ARE SOLELY RESPONSIBLE FOR COMPLIANCE WITH APPLICABLE LOCAL LAWS, INTERNATIONAL AND USA LAWS.

In the event of a grievance, you agree that any legal remedies will be by legally binding arbitration under Islamic guidelines as provided by by any of the following nationally respected Islamic organizations in North Ameica, or their duely appointed representative(s), in the role of arbitrator: Islamic Society of North America (ISNA), ICNA (Islamic Circle of North America), SSANA (Sariah Scholars Association of North America).

In the event any of the above is unenforceable you agree that that particular part will be replaced by an enforceable part that most closely matches the spirit and intent of the replaced part without changing the other parts of the TOU. For the purposes of your relationship to islamicwell.com, in case of conflict between different terms of service/use/legal/guidelines, the Terms of Use that are normally linkable from islamicwell.com's main page will be the dominating & superceding clause. If any provision of this TOU is held invalid, unenforceable or illegal for any reason, that provision will be deemed to apply only to the maximum extent permitted by law, and the remainder of this TOU will remain valid and enforceable in accordance with its terms. All rights not expressly granted herein are reserved.
